YouTube a clip - legal or not? - 2008/01/31 22:10 Hello all.

There's a debate in my theater group about the legality of uploading a video clip (not even a whole scene) of a particularly funny moment in one of our productions of Sweet Charity.

If all the people IN the clip approve, can it be uploaded to youtube (not for sale) without violating the rights of the company that owns the rights to the play?

The scripts were obtained properly, rights to perform and sell tickets, royalties paid, etc. and so forth.

It is permissible to use the logo and quotes in publicity items ... when those scripts were written, there was no such thing as youtube.

What is the standard nowadays ?

If you search for Sweet Charity on youtube you will find dozens and dozens of clips.

We were prepared to upload with giggles galore, however, the one budding lawyer in our midst objected if we were violating any of the copyright laws.

Guidance?

Short of cutting her out of the scene, (snicker) can this be done?

Thank you in advance for any advice.

GrannySuze

Edited because I'm too long winded and the subject line didn't make any sense. I mean, really, who's going to even READ a topic that makes no sense in the subject line!

Re:YouTube a clip - legal or not? - 2008/02/02 11:14 Not only is it illegal to place your clip on You Tube, it is illegal to videotape it in the first place. Some people try to get around it by saying they are videotaping the show for "archival" purposes. They have people "pay" for them so there are enough out there in case something happens to the other 14 (nudge-nudge, wink-wink). In fact, it probably states as much in the

When your company bought the performance rights, they bought the ability to perform it before a life audience, nothing else. They could have bought the broadcast rights, but that would have cost more.

Keep in mind, everyone videotapes their shows and a lot place clips on You Tube. I can't imagine anyone ever getting sued for it, but you could.

As an aside, I put clips of a show that was in last summer and one of the cast members was very offended by it. I am not sure why, and I think he over-reacted, but the director called said "cast members are complaining" - they weren't, it was A cast member, but people are weird - AND theatre people are the weirdest!

Re:YouTube a clip - legal or not? - 2008/02/02 20:13 this summer a friend of mine put up a clip of a rehearsal of "Greased Lightnin'"...the director found out and she had to take it down.

So from then on we've only posted BACKSTAGE funny moments, which there are plenty of!

Re:YouTube a clip - legal or not? - 2008/03/24 20:09 I think posting funny video moments from backstage is a great idea but it's sad for those of us with family in other parts of the country that we can't share an onstage moment via Youtube, which I love. Check out my Youtube site ( http://www.youtube.com/user/askagaydad ).
